Lapter is an associate of the firm.  He concentrates his practice on Intellectual Property and focuses on assisting clients with the selection, protection and management of domestic and international brands and brand portfolios.  He advises clients on licensing and service agreements involving intellectual property and conducting intellectual property due diligence and risk assessment in connection with corporate transactions.

With respect to trademarks and brands, Alain counsels clients from mark infancy onward.  Alain concentrates his practice on counseling clients on their intellectual property portfolios and rights, domestic and foreign trademark prosecution, trademark opposition and cancellation proceedings before the United States Patent and Trademark Office's Trademark Trial and Appeal Board, domain name protection, enforcement matters under both the Trademark Act and the Digital Millenium Copyright Act and trademark and trade dress litigation.  He has experience in drafting, reviewing and negotiating intellectual property agreements, including, co-existence agreements and trademark and copyright licenses.  Alain also counsels clients with respect to right of publicity and privacy issues in the on-line and offline context.

Alain has counseled a U.S.-based knife manufacturer with respect to trademark and trade dress infringement issues, right of publicity, copyright, marketing and overall brand management strategies.  Alain has also counseled a Navy foundation as to the breadth of trademark and copyright rights in a famous work and enforced such rights against numerous third parties. 

Alain has worked on several trademark infringement cases before U.S. District Courts that were settled in the preliminary stages of litigation.  In addition, Alain has handled several proceedings before the Trademark Trial and Appeal Board on behalf of domestic and international clients.

Alain received his bachelor's degree from the University of Colorado at Boulder in 1998 and his J.D. from the University of Connecticut School of Law in 2004.  Alain also earned an LL.M. in the Intellectual Property Law from The George Washington University of Law School in 2005.  While at the University of Colorado, Alain, a sports broadcasting major, won an Emmy Award for the Best Student Entertainment Program for his play-by-play of a CU Women's Volleyball game.  In law school, Alain was a member of Moot Court and participated in a Sport Law competition at the University of Tulane Law School and served as the law student division liaison to the American Bar Association Forum on Communications Law.
