BEAN, KINNEY & KORMAN REPRESENTS DEVELOPER 1210 NORTH HIGHLAND STREET IN PETER GLASSMAN, PLAINTIFF V. ARLINGTON COUNTY, VIRGINIA, ET. AL.
ARLINGTON, VA, April 13, 2010—Bean, Kinney & Korman, one of Arlington’s largest and most established law firms, represented developer 1210 North Highland –Clarendon, LP in the case of Peter Glassman v. Arlington County, Virginia, et. al, just dismissed. Mr. Glassman asserted that Arlington County gave preferential treatment to a secular affordable housing developer in violation of the Establishment Clause of the U.S. Constitution. Bean Kinney’s client, secular, non-profit developer 1210 N. Highland had already secured a $46 million loan for the housing project, which is currently under construction.
The case was dismissed on the grounds that the loan was not provided for a religious purpose, but rather is being used for the secular purpose of affordable housing development, and that the loan’s primary affect is not in support of a religious cause.
Jonathan Kinney of Bean Kinney & Korman represented 1210 N. Highland in closing the transaction. Raighne Delaney of Bean Kinney & Korman represented 1210 N. Highland in the litigation. Kinney has more than 30 years experience in land use, primarily in Arlington County. Delaney has prosecuted and defended numerous cases in real estate and construction litigation.
