RELATIONSHIP OF THE GENETIC INFORMATION NONDISCRIMINATION ACT OF 2008 AND THE FAMILY AND MEDICAL LEAVE ACTThe final regulations of the Equal Employment Opportunity Commission ("EEOC") implementing the Genetic Information Nondiscrimination Act of 2008 ("GINA") take effect on January 10, 2011. GINA applies to employers with 15 or more employees. The law prohibits discrimination against employees or applicants for employment because of genetic information, prohibits employers and other organizations from requesting, purchasing or requiring the disclosure of genetic information, and limits the disclosure of genetic information.
