Maureen E. Carr is a shareholder of Bean, Kinney & Korman whose practice focuses on employment law and commercial litigation. Clients rely on Maureen for practical, business-minded guidance and a strategic approach to resolving complex workplace and business disputes. Maureen also serves as outside general counsel to many of her clients, advising on day-to-day legal matters, contracts, employment issues, risk management, and dispute avoidance. She works closely with clients to understand their objectives, assess risk, and develop strategies designed to achieve efficient and effective outcomes, whether through counseling, negotiation, mediation, or litigation.

Employment Law
Maureen primarily represents employers in a broad range of employment law matters, including workplace counseling, policy development, internal investigations, administrative proceedings, and litigation. She helps clients manage workplace disputes from the earliest stages through resolution, with a focus on reducing risk, preserving leverage, and achieving practical outcomes, whether through counseling, negotiation, or litigation. She advises businesses, nonprofits, executives, boards, and management teams on sensitive employment issues. Maureen also represents senior executives in select matters involving employment agreements, restrictive covenants, compensation, separation, and ownership-related issues.

Her employment law experience includes matters involving:
· EEOC charges and related state agency proceedings involving claims of discrimination, harassment, and retaliation;
· FLSA and state law wage and hour claims, including claims for unpaid wages and overtime;
· Wage and hour audits by the Department of Labor;
· Leave and accommodation requests under the FMLA, ADA, USERRA, applicable state/local law, and employer policies;
· Workplace investigations, including allegations of discrimination, harassment, retaliation, and misconduct;
· Executive compensation, employment agreements, and separation agreements;
· Restrictive covenants, including non-competition, non-solicitation, confidentiality, and trade secret issues;
· Classification of employees and independent contractors;
· Employee discipline, performance management, and termination decisions;
· Drafting and enforcement of employment agreements and workplace policies; and
· Development of employment policies, procedures, and training programs.

Commercial Litigation
Maureen represents businesses and individuals in a variety of commercial litigation matters, with significant experience in disputes involving employment relationships, contracts, business torts, real estate, construction, and community associations. She works closely with clients to identify business objectives, evaluate litigation risk, and pursue the most effective path to resolution, whether through early negotiated resolution, mediation, dispositive motions, trial, or appeal.

Her commercial litigation experience includes disputes relating to:
· Employment agreements and restrictive covenants;
· Wage and hour issues;
· Discrimination, harassment, and retaliation claims;
· Contract disputes;
· Business torts, including tortious interference, breach of fiduciary duty, and civil conspiracy;
· Trade secrets and confidential business information;
· Contractor and property owner conflicts;
· Real estate transactions;
· Homeowners association and condominium association matters; and
· Warranty disputes.

Maureen litigates in the state and federal courts of Virginia, Maryland, and Washington D.C. with a particular emphasis on litigation on the U.S. District Court for the Eastern District of Virginia, Alexandria Division.

Experience

  • Negotiated successful resolution of gender discrimination dispute involving C-suite executive and nonprofit organization, following EEOC investigation and litigation in the U.S. District Court for the Eastern District of Virginia through discovery and summary judgment briefing.
  • Advised senior executive in connection with departure from company, including defense against alleged restrictive covenant violations, negotiation of alternative post-employment restrictions, and resolution of complex ownership interest issues.
  • Represented individual defendant in lawsuit brought by former employer alleging breach of contract and trade secret violations and facilitated favorable resolution before rulings on defendant’s motion to dismiss and plaintiff’s motion for preliminary injunction.
  • Negotiated resolution of dispute between technology company and former employee regarding employee’s compliance with restrictive covenants and trade secret/computer crimes statutes, with resolution involving monetary payment to client and employee’s agreement to continuing obligations.
  • Investigated allegations of racial harassment against private club, prepared detailed investigative report for board of directors, and advised board regarding response.
  • Secured monetary judgment for technology company against former sales employee related to disputed commission payment.
  • Negotiated resolution of dispute between media company and former employees related to breach of fiduciary duties, misappropriation of trade secrets, tortious interference, aiding and abetting, and civil conspiracy, with resolution involving monetary payment to client and employees’ agreement to continuing confidentiality, non-competition, and non-solicitation obligations.
  • Facilitated separation of owner from engineering firm, including resolution of disability/leave issues and redemption of ownership interest.
  • Successfully mediated real estate dispute in which client purchased condominium unit that was subject to certain undisclosed resale restrictions related to designation as “affordable housing unit.” Mediation involving client, seller, two title companies, and government body charged with enforcing restrictions resulted in monetary compensation to client and modification to restrictions.
  • Represented homeowners’ association in federal lawsuit against association’s insurance carrier alleging breach of insurer’s duty to defend association in a lawsuit. Following appeal to Fourth Circuit Court of Appeals, U.S. District Court for the Eastern District of Virginia ruled that insurer breached duty to defend and awarded association substantial amount of its attorneys’ fees and litigation costs.
